On March 11, 2010, the federal government of Canada, with the support of the provinces and territories, ratified the International Convention on the Rights of Persons with Disabilities (the Convention). As of March 12, 2010, 144 countries around the world had ratified the Convention which provides a human rights framework that addresses the rights of persons with disabilities in all aspects of their lives and communities. The key provisions of this Convention are summarized below. In addition, Canadians often ask about the legal effect of international conventions--how they are enforced and how one obtains a legal remedy in Canada when convention rights are violated. The Convention adopts a progressive definition of disability and recognizes that disability, "results from the interaction between persons with impairments and attitudinal and environmental barriers that hinder[s] their full and effective participation in society on an equal basis with others" (Preamble paragraph (e)). It ensures that persons with disabilities enjoy the same rights as everyone else. It covers a number of areas where persons with disabilities have not enjoyed their human rights such as education, employment, health, political participation, access to justice, accessibility, and mobility in society. In practice, this would result in such things as making electoral booths accessible, anti-discrimination practices in the workplace, and children with disabilities attending regular schools.
